The Security Deposit is an essential part of the rental process in the Dubai property market. Unlike in many other countries, there are clear regulations regarding the amount and handling of the deposit.
Legal basis and amount
In Dubai, the amount of the security deposit is not prescribed by law, but has become standardised in the market:
- Residential property: typically 5% of the annual rent
- Commercial property: mostly 10% of the annual rent
- Furnished flats: can be up to 10% of the annual rent
Intended use and protection
The deposit serves to secure various aspects:
- Damage to the property beyond normal wear and tear
- Outstanding ancillary costs (DEWA-invoices)
- Renovation work not carried out
- Breach of contract or premature cancellation
Important to know: In Dubai, the security deposit must be transferred separately from the rental payment. It is advisable to have the receipt of the security deposit confirmed in writing and to document the condition of the property in detail when moving in and out.
Repayment of the deposit
Repayment is usually made within 14-45 days after the end of the tenancy, provided that
- The property is in the agreed condition
- All invoices have been settled
- The rental agreement was duly fulfilled
As Best Practice it is advisable to set out the exact conditions for the repayment of the security deposit in writing when the contract is concluded. This avoids later discrepancies and ensures a smooth process at the end of the tenancy.
